Terms and Conditions

1. Scope

These terms apply to all services provided by Kübler Web & Design (owner: Jens Kübler) for businesses, freelancers, clubs and organizations. For consumers, these terms apply only insofar as mandatory consumer protection rules allow.

2. Services and offer

The scope of services results from the individual offer or order confirmation. Changes or extensions require written agreement.

3. Client cooperation

The client provides all required content, access data, files and information in time. Delays caused by missing cooperation are not the provider's responsibility.

4. Project process and acceptance

Progress is communicated and approvals are obtained. Upon written approval or productive use, the service is deemed accepted. Partial acceptances can be agreed.

5. Usage rights

After full payment the client receives the agreed usage rights. Open files are delivered only if expressly agreed.

6. Third-party services and licenses

If third-party services or licenses are required (e.g. stock images, fonts, plugins), they are transparently named. Costs and terms are governed by the respective provider.

7. Fees and payment

Fees are based on the offer. Unless agreed otherwise, payment is made in partial invoices (e.g. project start, mid project, handover). Invoices are due within 7 days.

8. Liability

Liability is unlimited in cases of intent and gross negligence and for injury to life, body or health. In case of slight negligence of essential contractual obligations, liability is limited to the foreseeable, typical damage. Any further liability is excluded.

9. Warranty

Statutory provisions apply. The client checks the service after delivery and reports defects without undue delay.

10. Special rules for 3D printing

The client provides print-ready files and confirms all required rights. The provider does not create or sell third-party 3D models. The service is limited to technical manufacturing based on client specifications.

11. Confidentiality

Both parties agree to keep confidential information and documents secret.

12. Final provisions

German law applies. The place of jurisdiction is Wernigerode, insofar as permissible. If any provision is invalid, the remaining provisions remain effective.
